The Association's current Certificate of Insurance is contained in the appropriately named file below. It can be provided to your lender and others involved in the purchase or refinancing of your condominium. Contact information for our insurance broker is included therein.

Attention Unit Owner at Fox Bay Condominiums

SB 167, was passed into law during the 2011 general session of the Utah Legislature which affects your rights as a unit owner in the condominium association.

Notice of Deductible under Fox Bay HOA Master Insurance Policy

The new amendments to state law require us to inform you of the amount of the policy deductible on the master condominium insurance policy and your responsibility for that amount in the event of a loss.  Effective August 9, 2021 the deductible increased to $20,000.

A complete copy of the law can be found online for your review at https://le.utah.gov/~2011/bills/sbillenr/sb0167.htm.  An article was published online at ksl.com which summarizes the law and its implications for you as a unit owner:

"Senate Bill 167 significantly amends associations’ and owner’ insurance obligations by establishing that individual owners will be responsible for the payment of the applicable insurance deductibles when an association’s and unit owner’s insurance coverages both provide coverage for a loss. The association’s carrier will be responsible for all damages above the amount of the deductible. In the event that several units are involved, the damages will be assessed among the association’s carrier and the carriers for the affected unit owner."

"While the new law doesn’t mandate that unit owners obtain coverage, it establishes their liability for the amount of the deductible, whether or not the owner actually obtains insurance."

"Unit owners who are responsible for the deductible and who do not have coverage could have a lien filed against their unit and face collection proceedings from the association. The act also requires that associations keep their owners apprised of the amount of the deductible and the owners’ responsibility for that amount."

 We strongly recommend that you purchase your own condo unit owners policy, commonly known as an HO6 policy. They are very affordable, and it will protect the owner from being liable for the Master Policy deductibles. Rental owners should also require Renter insurance from their tenants.
